By accessing or using Givly ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services.
Givly provides a digital website building tool and hosting services designed for creating personal gift sites. The service allows users to design, publish, and share digital content via a unique URL. Your content is hosted securely using industry-standard cloud storage providers (such as Cloudflare R2) to ensure reliability and performance.
Givly provides generous bandwidth for personal, non-commercial use (e.g., sharing with loved ones). While we do not enforce hard visit caps, we reserve the right to throttle or temporarily suspend sites that consume excessive bandwidth disproportionate to personal usage (e.g., viral traffic or hotlinking images). If your site exceeds typical personal usage patterns, we may contact you to upgrade to a commercial plan.
The term "Lifetime" refers to the lifetime of the Service (Givly), not the lifetime of the user. You will have access to your published site for as long as Givly remains active and commercially viable. We reserve the right to discontinue the Service at any time.
Givly reserves the right to modify, suspend, or discontinue the Service at any time. In the unlikely event that we shut down the platform, we will make reasonable efforts to provide at least seven (7) days' notice via email to allow you to back up your data. We are not liable for any loss of content after this period.
You retain ownership of all photos and text you upload ("Your Content"). However, by displaying Your Content, you grant Givly a license to host and display it for the purpose of providing the Service. You agree NOT to upload content that is:
Givly reserves the right to remove any site immediately and without refund if it violates these standards.
Please be aware that any content you publish is accessible to anyone who possesses the unique link to your site. Givly is not responsible for the privacy of information you voluntarily disclose on published sites.
Due to the immediate digital nature of the product (instant hosting and link generation), all sales are final. Exceptions may be made at our sole discretion only in cases of technical failures that prevent the service from functioning.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Givly makes no warranties that the service will be uninterrupted or error-free. To the fullest extent permitted by law, Givly shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service.
These Terms will be governed by and interpreted in accordance with the laws of Malaysia. You submit to the non-exclusive jurisdiction of the courts located in Malaysia for the resolution of any disputes.
